These Terms of Service ("Terms") govern your use of pipandglitch.com (the "Site"), operated by MendozaLab (Ken Mendoza and Toni Bailey), based in Portland, Oregon, USA. Please read them before using the Site.

Acceptance of terms

By visiting or using this Site, you agree to these Terms. If you don't agree, please don't use the Site.

Who can use this site

This Site is intended for adults — parents, educators, and librarians — who are acquiring the Pip & Glitch books for children. You must be 13 or older to use any part of the Site, or use it with a parent or guardian's consent, for the account/waitlist portion of the Site. There is no direct signup available to children under 13; see our Privacy Policy for details.

The Pip & Glitch book itself is written for children ages 4–8, but it is intended to be read with, or under the supervision of, an adult, and it is purchased by adults — currently via Amazon. If you buy the book through Amazon, Amazon's own terms of service also apply to that purchase.

Content ownership

The Pip & Glitch characters, illustrations, story text, and related artwork are © MendozaLab. All rights reserved. The source code that runs this website is proprietary to MendozaLab unless a specific file or repository states otherwise (for example, an open-source license file included with that code).

You may not reproduce, distribute, or create derivative works from our characters, illustrations, or text without our written permission.

User content

At the moment, this Site does not have a public comments, reviews, or user-submission feature. If we add one in the future (for example, book reviews or classroom photos), this section will be updated to explain what rights you grant us in anything you submit, and what standards apply to it. Until then, this section is a placeholder.

Disclaimers

The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't guarantee that the Site will be uninterrupted, error-free, or completely secure. We make no warranty regarding the accuracy, reliability, or completeness of any content on the Site.

Limitation of liability

To the extent permitted by Oregon law, MendozaLab's total liability to you for any claim arising from your use of the Site is limited to $50 USD, or the amount you paid us in the 12 months before the claim arose, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages.

Indemnification

You agree to indemnify and hold MendozaLab, its founders, and any contributors harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from your misuse of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law principles.

Dispute resolution

If a dispute arises, we ask that you first contact us at [email protected] so we can try to resolve it informally. If we can't resolve it informally, any dispute will be handled in the state or federal courts located in Multnomah County, Oregon, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the Site after changes means you accept the updated Terms.

A note on sales

As of this writing, we don't sell anything directly through this Site — the book is available via Amazon KDP, and Amazon's terms and policies govern that purchase. When we launch direct sales (planned for Phase 1, via Lemon Squeezy), these Terms will be updated to include applicable sales terms.
